1. About these terms

These Terms of Use & Service ("Terms") apply when you visit thevillij.com or book, buy, rent or take part in anything offered by The Villij Wellness Inc. ("The Villij", "we", "us"). That includes studio classes and workshops, memberships and class packs, corporate experiences, studio and equipment rentals, products, gift cards and retreats.

By using our website or making a booking or purchase, you agree to these Terms, our Booking & Cancellation Policies and our Privacy Policy. If you book on behalf of other people, you agree that they will follow these Terms too.

Some services also come with a separate agreement, such as a participant waiver, rental agreement, corporate service agreement or retreat agreement. If a separate agreement conflicts with these Terms, the separate agreement applies.

3. Using our website

The content on thevillij.com, including text, photos, videos, class names, logos and designs, belongs to The Villij or our licensors. You may view and print pages for your own personal use. You may not copy, republish, sell or redistribute our content, or use our name or logo, without our written permission.

You are welcome to link to our website, as long as the link is not misleading and does not suggest we endorse you. Please do not frame our pages or change how they look. We may ask you to remove a link at any time.

We work to keep our website accurate and available, but we do not guarantee that it is always complete, current or error-free. Prices, schedules and offerings can change. Links to other websites are provided for convenience; we are not responsible for their content or practices.

4. Bookings and payments

  • Where you book: classes and memberships are booked through Momence, retreats through WeTravel, and studio rentals directly with us or through Peerspace. Each platform's own terms also apply to your use of it.

  • Prices and taxes: prices are in Canadian dollars unless stated otherwise. Applicable taxes are added at checkout. Payment processing fees may apply and are shown before you pay.

  • Payment: payments are processed securely by our payment providers, including Stripe. We do not store full card numbers.

  • Payment plans: if you choose a payment plan, you authorize us to charge your card on the dates shown when you booked. If a payment fails, we may pause your booking until it is paid.

  • Cancellations and refunds: see our Booking & Cancellation Policies. They form part of these Terms.

  • Our changes: we may need to change an instructor, time or location, or cancel an offering. If we cancel, you will receive a full credit or refund for that booking.

5. Health, safety and assumption of risk

Yoga, Pilates, breathwork, sound baths, travel and other physical activities carry a risk of injury. By taking part, you accept that risk.

  • You confirm that you are 18 or older and physically able to take part, and you will check with a health care provider before starting if you have any concerns.

  • Tell your instructor before class about any injury, condition, pregnancy or limitation that may affect your practice.

  • Listen to your body, rest when you need to, and stop if you feel pain, dizziness or discomfort. Every practice is optional.

  • You must sign our participant waiver before your first class, rental or event. Retreat guests also sign a retreat agreement.

  • Instructors may offer hands-on adjustments only with your consent. You can decline at any time.

  • We are not responsible for lost, stolen or damaged personal belongings.

6. Studio classes, memberships and class packs

  • Class packs and memberships are for the named account holder only and cannot be shared, unless we agree otherwise in writing.

  • Class packs expire on the date shown at purchase and in your Momence account. Unused classes are not refundable after they expire.

  • Please arrive at least 10 minutes early. Late arrivals may not be admitted once class has started, for safety and out of respect for others.

  • Mats and props are provided. Please return them clean and in their place.

7. Corporate experiences

Corporate workshops, team events and wellness programs are governed by a signed service agreement and statement of work. These set out the services, pricing, participant numbers, payment terms and cancellation terms for each client. Participants in corporate sessions must complete our participant waiver.

8. Studio and equipment rentals

Studio rentals. The renter is responsible for their event, their guests and the condition of the space during the booking. Renters must follow our studio rules, which include:

  • No early access. Setup and breakdown happen within your booked time, and everything is returned to its original place.

  • Extra time beyond your booking is charged at $2 per minute.

  • Light snacks and non-alcoholic drinks only. The fridge and kitchen cupboards are off-limits.

  • No smoking, open flames, incense, parties, loud music, or decorations on the walls.

  • No animals, except certified service animals. Shoes off at the door.

  • Maximum capacity of 20 participants.

  • The renter pays for any damage, extra cleaning or unauthorized use of studio items.

  • The space may not be sublet or used for any purpose other than the one booked.

Renters running classes or events for their own clients are responsible for their own participant waivers and insurance.

Mat and props rentals. We deliver and pick up all rental equipment; self pick-up is not available. The renter is responsible for the equipment from delivery until pickup and will be charged the replacement cost of any items that are lost or damaged beyond normal wear.

9. Products

All product sales are final. If an item arrives damaged or defective, contact us within 7 days of receiving it and we will replace it or exchange it for the same item.

10. Gift cards

Gift cards do not expire, cannot be redeemed for cash, and are not replaced if lost or stolen.

11. Retreats

Retreat bookings are governed by these Terms, the retreat cancellation policy in our Booking & Cancellation Policies, and the retreat agreement each guest signs.

  • Insurance: travel insurance covering medical emergencies, trip cancellation and lost belongings is mandatory. Proof is required before departure.

  • Travel documents: you are responsible for a valid passport, visas, vaccinations and any entry requirements for the destination, and for arriving on time.

  • What's included: inclusions are listed on each retreat page. Flights, insurance, visas and personal expenses are not included unless stated.

  • Itinerary changes: we may change activities, schedules, suppliers or accommodations for safety, weather or availability, and will offer a comparable alternative where possible.

  • Third-party suppliers: resorts, tour operators and transport providers are independent businesses. We choose them carefully but are not responsible for their acts or omissions.

  • If we cancel: if we cancel a retreat, for example because minimum numbers are not met, you will receive a full refund of the amounts paid to The Villij. We are not responsible for flights or other costs you booked separately.

  • Events beyond our control: we are not liable for delays or cancellations caused by events beyond our reasonable control, such as natural disasters, pandemics, government travel advisories, strikes or political unrest. In those cases we will offer a credit toward a future Villij experience where possible.

12. Photos and media

We sometimes take photos and video at classes, events and retreats to share our community's story. We will tell you when content is being captured. If you prefer not to appear, let your instructor or host know and we will respect that. Retreat guests and collaborators may be asked to sign a separate photo and video release.

Please respect other guests' privacy. Do not photograph or film other people without their permission.

13. Community and conduct

The Villij is a space for rest, care and connection. We ask everyone to treat guests, instructors and staff with respect. We may refuse service, end a booking or remove someone from a class, rental, event or retreat, without a refund, if their behaviour is unsafe, harassing, discriminatory or disruptive.

14. Limitation of liability

To the maximum extent permitted by law:

  • our website and services are provided "as is", without warranties of any kind beyond those required by law;

  • we are not liable for any indirect, incidental or consequential loss, including lost profits, missed travel or lost enjoyment; and

  • our total liability for any claim relating to a booking or purchase is limited to the amount you paid for it.

Nothing in these Terms limits liability that cannot be limited under applicable law, including your rights under Ontario consumer protection law, or liability for fraud, gross negligence or death or personal injury caused by negligence.

15. Indemnity

You agree to cover any claims, losses or costs (including reasonable legal fees) that arise from your breach of these Terms, your misuse of the studio or rental equipment, or, for renters and corporate clients, the acts of your guests or participants.

16. Privacy

Our Privacy Policy explains how we collect, use and protect your personal information.

17. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "last updated" date. Changes do not affect bookings already confirmed, unless the law requires otherwise.

18. Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Any dispute will be handled in the courts of Ontario, unless consumer protection law where you live gives you the right to bring it elsewhere.
